GSA ORDER
SUBJECT: Delegation of Authority
1. Purpose. This order delegates to the Senior Procurement Executive ((SPE) the authority to grant or deny access to the Federal Awardee Performance and Integrity Information System (FAPIIS).
2. Background. Pursuant to 41 U.S.C. § 417b, GSA is required to develop and maintain FAPIIS, a data system containing specific information regarding the integrity and performance of covered Federal agency contractors and grantees.
FAPIIS provides one-stop access to several categories of data about past, current, and potential Federal government contractors for the most recent five-year period. This data is drawn from several Government databases, including, but not limited to, the Excluded Parties List System (EPLS) and the Past Performance Information Retrieval System (PPIRS). As development continues,
FAPIIS will potentially also include agency non-responsibility determinations, contract and grant terminations for default, administrative agreements entered into by suspension and debarment officials, and contractor self-reporting of criminal convictions, civil liability, and adverse administrative actions. TheAdministrator is required to ensure that the information in FAPIIS is made available to appropriate acquisition officials of Federal agencies, to such other Government officials as the Administrator determines appropriate, and, upon request, to the Chairman and Ranking Member of the Committees of Congress having jurisdiction. Further, GSA is required via P.L. 111-212, § 3010, to make FAPIIS publicly available on the Internet, except for information regarding past performance.
3. Delegation of Authority. Effective immediately, the SPE is delegated authority to grant or deny access to FAPIIS. In the exercise of this delegated authority, the SPE must comply with the requirements of the authorities enumerated above, as well as any related information technology and acquisition policies.
4. Implementing actions. The SPE, in conjunction with other appropriate officials, shall take the actions needed to implement this order.
